Vyrtaspire — Terms of Service

Welcome to Vyrtaspire. These Terms of Service ("Terms") govern your access to and use of the Vyrtaspire mobile game application ("Game"), available on Android and iOS platforms, and any related services provided by Vyrtaspire ("Company", "we", "us", or "our").

Please read these Terms carefully before using the Game. By downloading, installing, or using the Game, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the Game, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree to these Terms, you must not download, install, or use the Game.

If you are under the age of 13 (or the minimum age required in your jurisdiction), you may not use the Game. If you are between 13 and 18 years of age (or the age of legal majority in your jurisdiction), you may only use the Game with the consent of a parent or legal guardian who agrees to be bound by these Terms.

2. Game License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Game on a compatible mobile device that you own or control, solely for your personal, non-commercial entertainment purposes.

You may not:

Copy, modify, distribute, sell, lease, sublicense, or create derivative works of the Game or any part thereof.
Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Game.
Remove, alter, or obscure any copyright, trademark, or other proprietary notices in the Game.
Use the Game for any commercial purpose or in any manner not expressly permitted by these Terms.
Transfer your license or account rights to another person or entity.

We reserve the right to revoke this license at any time, for any reason, with or without notice.

3. Account and Authentication

When you first launch the Game, an anonymous account is automatically created for you. This account is tied to your device and allows you to play the Game and save your progress locally.

You may optionally link your account to a third-party authentication provider (such as Google, Facebook, or Apple) to enable features like cloud save and cross-device access. When you link a third-party account:

You authorize us to access certain information from your third-party account as described in our Privacy Policy.
You are responsible for maintaining the security of your third-party account credentials.
You are responsible for all activity that occurs under your account.

We are not responsible for any loss or damage arising from your failure to maintain the security of your account. We reserve the right to suspend or terminate any account at our discretion if we believe these Terms have been violated.

4. Virtual Currencies and In-App Purchases

The Game offers two virtual currencies:

Coins -- earned through gameplay or purchased with real money. Used to buy and upgrade weapons, repair walls, and other in-game actions.
Murmures (Whispers) -- earned through the prestige mechanic or purchased with real money (subject to rate limits). Used for permanent progression bonuses.

By making an In-App Purchase ("IAP"), you acknowledge and agree that:

Virtual currencies and items have no real-world monetary value and cannot be exchanged for real money, goods, or services.
All purchases are final and non-refundable, except as required by applicable law or the policies of the platform (Google Play, Apple App Store) through which the purchase was made.
Virtual currencies and items are non-transferable and may not be sold, traded, or given to other players.
We reserve the right to manage, regulate, modify, or remove virtual currencies and items at our sole discretion, without liability to you.
Murmures purchases are rate-limited (e.g., one purchase per day or per week) to preserve the integrity of the prestige gameplay loop.

Pricing for IAPs is set by us and displayed in your local currency through the applicable platform store. We may change prices at any time without prior notice.

5. Cloud Save

If you link your account to a third-party authentication provider, your game progression may be synchronized to our cloud servers (powered by Firebase Firestore).

Cloud save is provided on a best-effort basis. While we take reasonable measures to protect your data:

We do not guarantee that your data will be preserved, accurate, or available at all times.
We are not liable for any loss of game progress, virtual currencies, upgrades, or other data due to technical failures, service interruptions, bugs, or any other cause.
You are solely responsible for any risks associated with relying on cloud save functionality.

The Game is designed to be playable offline. Cloud save and leaderboard features require an active internet connection.

6. Leaderboard and Fair Play

The Game includes a leaderboard system with weekly leagues. By participating in leaderboards, you agree to:

Play fairly and honestly at all times.
Not use any cheats, exploits, automation software, bots, hacks, mods, or any unauthorized third-party tools to manipulate your score, progress, or ranking.
Not engage in any form of score manipulation, including but not limited to exploiting bugs, colluding with other players, or artificially inflating scores.
Not tamper with, modify, or interfere with the Game's client, server, or network communications.

We reserve the right to remove scores, reset progress, suspend, or permanently ban accounts that we reasonably believe have violated these rules, without prior notice and without obligation to provide evidence of the violation.

7. Advertising

The Game contains rewarded advertisements ("Rewarded Ads"). These are voluntary: you may choose to watch an ad in exchange for an in-game reward (such as doubled wave earnings). You are never required to watch an ad to continue playing.

Advertisements are served by third-party ad networks. By using the Game, you acknowledge that:

Third-party ad networks may collect certain data from your device to serve personalized ads, as described in our Privacy Policy.
We do not control the content of third-party advertisements and are not responsible for any products, services, or content advertised.
Ad availability may vary depending on your region, device, and network connection.

8. User Conduct and Acceptable Use

You agree to use the Game only for lawful purposes and in accordance with these Terms. You must not:

Use the Game in any way that violates any applicable local, national, or international law or regulation.
Attempt to gain unauthorized access to any part of the Game, its servers, systems, or networks.
Introduce any viruses, trojans, worms, malware, or other harmful or disruptive material.
Interfere with or disrupt the integrity or performance of the Game or its related systems.
Harass, abuse, threaten, or harm other players or any person associated with the Game.
Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
Use the Game to transmit any unsolicited advertising, spam, or promotional material.
Exploit any bug, glitch, or design flaw in the Game for unintended advantage, and you agree to report any such issues to us promptly.

9. Intellectual Property

The Game and all of its content, including but not limited to text, graphics, images, audio, music, visual effects, animations, game mechanics, software code, user interface design, and trademarks, are the exclusive property of Vyrtaspire or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Nothing in these Terms grants you any right, title, or interest in or to the Game or its content, except for the limited license described in Section 2. All rights not expressly granted are reserved by us.

If you believe that any content in the Game infringes your intellectual property rights, please contact us at the address provided in Section 14.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

The Game is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Game will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
In no event shall Vyrtaspire, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your access to or use of (or inability to access or use) the Game.
Our total aggregate liability to you for all claims arising out of or relating to the Game shall not exceed the amount you have paid to us for In-App Purchases in the twelve (12) months preceding the claim, or ten euros (EUR 10), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so the above limitations may not apply to you in full. In such cases, our liability will be limited to the greatest extent permitted by applicable law.

11. Termination

These Terms are effective until terminated by either you or us.

By you: You may terminate these Terms at any time by uninstalling the Game and ceasing all use. If you have a linked account, you may request account deletion by contacting us at the address provided in Section 14.

By us: We may suspend or terminate your access to the Game at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, fraudulent or illegal activity, or discontinuation of the Game.

Upon termination:

Your license to use the Game is immediately revoked.
You lose access to your account, virtual currencies, items, progress, and any other data associated with your use of the Game.
No refund will be provided for any prior In-App Purchases.
Sections that by their nature should survive termination (including Sections 4, 9, 10, and 12) will continue to apply.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction Placeholder], without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or your use of the Game shall be subject to the exclusive jurisdiction of the courts of [Jurisdiction Placeholder].

You agree to attempt to resolve any disputes informally by contacting us first. If a dispute is not resolved within thirty (30) days of your initial contact, either party may pursue formal legal proceedings.

13. Changes to These Terms

We reserve the right to modify or replace these Terms at any time, at our sole discretion. If we make material changes, we will notify you by:

Posting the updated Terms within the Game or on our website.
Updating the "Last updated" date at the top of this page.
Displaying an in-game notification when significant changes are made.

Your continued use of the Game after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree with the updated Terms, you must stop using the Game and uninstall it.

We encourage you to review these Terms periodically for any changes.
